La propiedad de este sitio web, https://sustax.earth (en adelante, “Sitio Web” o “Sustax”), pertenece a la empresa legalmente constituida y operativa en España, Geoskop Sociedad Limitada, con NIF B-67592113 y registrada en el Registro Mercantil de Barcelona con los siguientes datos registrales: Tomo 47242, Folio 80, Sección 8, Hoja B 545845, Inscripción 1, de fecha 12 de febrero de 2020. Este documento regula las condiciones (en adelante, “Condiciones”) que rigen el uso de este Sitio Web (https://app.sustax.earth) y la compra y adquisición de datos y/o servicios en el mismo.

A efectos de estas Condiciones, se entiende que la actividad realizada por Geoskop Sociedad Limitada a través del Sitio Web Sustax consiste en la comercialización y provisión de Créditos Sustax (“créditos digitales” o “Créditos Sustax”), que permiten al Usuario adquirir, acceder y descargar hasta 102 años de datos climáticos de alcance global, generados originalmente y postprocesados por Geoskop Sociedad Limitada a partir de modelos climáticos CMIP6 y modelos de reanálisis climático ERA5, siempre de acuerdo con las normas internacionales y recomendaciones del IPCC (Panel Intergubernamental sobre Cambio Climático).

El servicio ofrecido en el Sitio Web corresponde a un servicio digital, principalmente sin soporte físico, en el cual el Usuario puede descargar los datos adquiridos en formato CSV para uso profesional, académico o personal, siempre bajo las condiciones establecidas en este documento y la normativa aplicable.

Además de leer estas Condiciones, antes de acceder, navegar y/o usar este sitio web, el Usuario debe haber leído el Aviso Legal y los Términos Generales de Uso, incluida la Política de Cookies y la Política de Privacidad y Protección de Datos de Geoskop Sociedad Limitada. Al usar este Sitio Web o al realizar y/o solicitar la adquisición de datos a través del mismo, el Usuario acepta estar sujeto a estas Condiciones y a todo lo mencionado anteriormente, por lo que, si el Usuario no está de acuerdo con alguna de ellas, no debe usar este Sitio Web.

También se informa que estas Condiciones pueden ser modificadas. El Usuario es responsable de consultarlas cada vez que acceda, navegue y/o use el Sitio Web, aplicándose las vigentes en el momento de la adquisición de productos y/o servicios.

Para cualquier consulta que el Usuario pueda tener sobre las Condiciones, puede contactar al propietario utilizando los datos de contacto proporcionados arriba o, en su caso, mediante el formulario de contacto.


2. EL USUARIO

El acceso, navegación y uso del Sitio Web confiere la condición de Usuario (en adelante, referido indistintamente como Usuario o Usuarios), aceptando, desde el momento en que inicia la navegación en el Sitio Web, todas las Condiciones establecidas en el presente documento, así como sus modificaciones posteriores, sin perjuicio de la normativa legal aplicable.

El Usuario asume la responsabilidad por el correcto uso del Sitio Web. Esta responsabilidad se extiende a:

  • Usar este Sitio Web únicamente para consultas y adquisiciones válidas legalmente.
  • No realizar compras falsas o fraudulentas. Si se considera razonablemente que se ha realizado una compra de este tipo, podrá ser cancelada y las autoridades competentes serán informadas.
  • Proporcionar datos de contacto veraces y legales, como correo electrónico, dirección postal y/o otros datos (véase Aviso Legal y Términos Generales de Uso).

El Usuario se compromete a usar el Sitio Web exclusivamente con fines lícitos y a no realizar actos que puedan perjudicar a Geoskop Sociedad Limitada, otros usuarios o terceros. El Usuario es responsable del correcto uso de los datos climáticos adquiridos y/o los servicios proporcionados, así como de la confidencialidad de sus credenciales y de todas las actividades realizadas bajo su cuenta.

El Usuario declara ser mayor de 18 años y tener la capacidad legal necesaria para celebrar contratos a través de este Sitio Web, Sustax.


3. PROCESO DE COMPRA DE CRÉDITOS SUSTAX Y ADQUISICIÓN DE DATOS CLIMÁTICOS

El Usuario debidamente registrado puede comprar créditos Sustax (denominados “Créditos Sustax”) por adelantado registrándose y accediendo posteriormente a su cuenta personalizada en el Sitio Web (https://app.sustax.earth).

La compra de créditos se realiza a través de la plataforma de pago seguro Stripe (https://stripe.com/es), que garantiza la confidencialidad y seguridad de los datos de pago del Usuario.

Una vez adquiridos, los créditos estarán disponibles en la cuenta personal del Usuario, listos para acceder y descargar cualquier dato climático disponible en la plataforma Sustax.

El Usuario debidamente registrado puede adquirir cualquiera de los datos climáticos disponibles en el Sitio Web mediante un proceso digital. El Usuario debe seguir el procedimiento de adquisición en línea del Sitio Web, durante el cual podrá seleccionar distintos conjuntos de datos climáticos, añadirlos al carrito de compras y hacer clic en “Confirmar” para proceder.

El Usuario pasará por una doble validación para la adquisición de los datos climáticos. Durante este proceso, el Usuario debe verificar y confirmar la información proporcionada en cada paso antes de efectuar el pago. En cualquier momento, podrá modificar los datos antes de completar la compra.

Tras la adquisición, el Usuario recibirá un correo electrónico de confirmación de Geoskop Sociedad Limitada, que incluirá un enlace para acceder a los datos climáticos adquiridos.

Los créditos pueden utilizarse para acceder a diferentes datos climáticos ofrecidos por Sustax, descontándose del saldo según el coste de cada conjunto de datos seleccionado.

El Usuario puede visualizar y descargar la factura electrónica correspondiente, que se enviará por correo electrónico y estará disponible en su área personal en el Sitio Web. Además, el Usuario puede consultar su historial de adquisición de datos climáticos en el Sitio Web.

El Usuario no tiene derecho a recibir actualizaciones de los datos climáticos adquiridos; se requerirá una nueva adquisición para datos actualizados. Geoskop Sociedad Limitada informará a todos los usuarios sobre la disponibilidad de nuevos datos y versiones lo antes posible.

El Usuario reconoce, en el momento de la compra, que conoce ciertas condiciones de venta específicas relativas a los datos climáticos de este Sitio Web y mostradas junto a su presentación, así como las limitaciones e incertidumbres de los datos climáticos ofrecidos por Sustax.

Finalmente, cualquier comunicación, pedido de compra y pago realizado durante las transacciones en el Sitio Web podrá ser archivado y conservado en los registros informatizados de Geoskop Sociedad Limitada como prueba de dichas transacciones, siempre respetando condiciones de seguridad razonables y la legislación aplicable, especialmente el Reglamento (UE) 2016/679 del Parlamento Europeo y del Consejo, de 27 de abril de 2016, sobre la protección de las personas físicas en lo que respecta al tratamiento de datos personales y a la libre circulación de estos datos (RGPD), y la Ley Orgánica 3/2018 de 5 de diciembre de Protección de Datos Personales y garantía de derechos digitales, así como los derechos otorgados a los Usuarios según la política de privacidad de este Sitio Web.


4. DISPONIBILIDAD

Geoskop Sociedad Limitada se compromete a garantizar que todos los pedidos realizados a través del Sitio Web estén disponibles para el Usuario de acuerdo con los procedimientos y plazos establecidos, salvo casos de circunstancias excepcionales o fuerza mayor.

Créditos Sustax y Datos Climáticos:

  • Los Créditos Sustax adquiridos por el Usuario permanecerán disponibles mientras el Sitio Web continúe operativo.
  • En el caso de datos climáticos adquiridos con Créditos Sustax, su disponibilidad y entrega mediante acceso digital directo están garantizadas durante 90 días desde la fecha de compra.

Garantía de Entrega:
La entrega de los conjuntos de datos climáticos adquiridos se realiza digitalmente, generalmente por correo electrónico y a través de la cuenta personal del Usuario. En circunstancias excepcionales (por ejemplo, entrega en soporte físico), se aplicarán condiciones específicas comunicadas durante el proceso de adquisición.

Acuerdo de Nivel de Servicio (SLA):
Geoskop Sociedad Limitada garantiza una disponibilidad media mensual del 99% para el acceso al Sitio Web, excluyendo causas fuera del control de la empresa.
En caso de incidencias técnicas, Geoskop hará esfuerzos razonables para restaurar el servicio, con un tiempo máximo de resolución de 24 horas para incidencias reportadas, salvo causas atribuibles a proveedores externos o eventos de fuerza mayor.

Fuerza Mayor:
Si, por cualquier motivo, los Créditos Sustax y/o los datos climáticos no pueden ser entregados debido a errores del Sitio Web, imposibilidad técnica o fuerza mayor, Geoskop Sociedad Limitada notificará al Usuario y ofrecerá dichos créditos o datos por medios manuales.

En situaciones de fuerza mayor (desastres naturales, huelgas, interrupciones de red, órdenes gubernamentales, etc.), Geoskop quedará exonerado de responsabilidad durante la duración del evento y dispondrá de un período adicional equivalente para cumplir con sus obligaciones.

Incidentes Técnicos y Mantenimiento:
El Sitio Web puede estar temporalmente no disponible por mantenimiento, actualizaciones o incidentes técnicos imprevistos. Estas situaciones serán comunicadas a los Usuarios a través de los canales habituales y no se considerarán incumplimiento contractual si no superan períodos razonables o se producen repetidamente.

Riesgo y Responsabilidad:
Cualquier riesgo asociado con los datos climáticos adquiridos será asumido por el Usuario desde el momento de la entrega.

El Usuario puede consultar el historial completo de sus adquisiciones de datos climáticos y compras de Créditos Sustax desde su cuenta personal en el Sitio Web.

5. PRECIOS Y PAGO

La compra de Créditos Sustax se realiza en Euros (€) e incluye impuestos, salvo que la ley indique lo contrario, particularmente en relación con el IVA. El precio mostrado en la plataforma en la moneda local seleccionada por el Usuario tiene carácter informativo y puede estar sujeto a variaciones por fluctuaciones del mercado de divisas.

El Sitio Web proporciona un sistema de visualización del precio de los créditos Sustax en la moneda elegida por el Usuario, solo con fines informativos. Se advierte expresamente a los Usuarios que:

  • El tipo de cambio aplicado por la plataforma puede no coincidir con el aplicado por el banco del Usuario debido a comisiones y otros factores.
  • El precio en moneda local puede variar según las fluctuaciones del mercado de divisas.
  • Sustax actualiza su API de tipo de cambio cada 24 horas; por lo tanto, el precio mostrado es solo orientativo y no vinculante al momento del cargo real.

El Usuario dispone de un botón en la plataforma para confirmar si, según la normativa europea, sus compras de Créditos Sustax están exentas de IVA. Esta verificación se realiza utilizando los datos ingresados por el Usuario en su inicio de sesión personalizado. Por ello, se aconseja al Usuario completar correctamente toda la información fiscal solicitada en su inicio de sesión personalizado en el Sitio Web.

Estructura del proceso de pago:

  1. Compra de Créditos Sustax: El Usuario compra una cantidad determinada de créditos por adelantado, en Euros (€), que se cargan en su cuenta personal dentro de la plataforma para su posterior uso.
  2. Compra de datos climáticos con Créditos Sustax: Una vez disponibles los créditos en la cuenta, el Usuario podrá utilizarlos para acceder y descargar los distintos datos climáticos ofrecidos en el Sitio Web, deduciéndose del saldo la cantidad correspondiente al tipo de datos solicitados.

Los precios de los datos climáticos disponibles en la plataforma Sustax se expresan en “Créditos Sustax”, cuyo costo específico depende del tipo de datos climáticos seleccionados, según se detalla en el sitio web de Sustax.

Métodos de pago:

  • Pago con tarjeta de crédito o débito, gestionado a través de la plataforma de pago electrónico Stripe (https://stripe.com/es).
  • Transferencia bancaria: Si el Usuario desea pagar mediante transferencia bancaria, deberá contactar directamente a Geoskop Sociedad Limitada en info@geoskop.tech para acordar los términos específicos de la operación.

Las tarjetas de crédito están sujetas a verificación y autorización por parte del banco emisor. Si el banco no autoriza el pago, Geoskop Sociedad Limitada no será responsable de ningún retraso o no entrega y no podrá formalizar contrato alguno con el Usuario.

Una vez que Geoskop Sociedad Limitada reciba la orden de compra del Usuario a través del Sitio Web, se realizará una preautorización en la tarjeta correspondiente para garantizar fondos suficientes para completar la transacción. La tarjeta será cargada en el momento en que se envíe la confirmación del envío y/o la confirmación del servicio proporcionado al Usuario, según lo establecido.

Geoskop Sociedad Limitada utiliza todos los medios para garantizar la confidencialidad y seguridad de los datos de pago transmitidos por el Usuario durante las transacciones a través del Sitio Web. Así, el Sitio Web utiliza un sistema de pago seguro SSL (Secure Socket Layer).

Registro y Documentación:

  • Compra de Créditos Sustax: Una vez completada la compra, el sistema generará automáticamente una factura electrónica, accesible en el espacio personal del Usuario dentro de la plataforma.
  • Adquisición de datos climáticos: Para cada transacción de adquisición de datos climáticos usando Créditos Sustax, el sistema emitirá automáticamente una factura, que se registrará en la cuenta del Usuario junto con la documentación correspondiente a la transacción.

Condiciones adicionales:

  • Bajo ninguna circunstancia, el Sitio Web agregará automáticamente costes adicionales al precio de un producto o servicio, salvo los seleccionados voluntaria y libremente por el Usuario.
  • Geoskop Sociedad Limitada se reserva el derecho de modificar precios en cualquier momento, garantizando que los precios aplicados a pedidos confirmados no se alterarán.
  • Geoskop Sociedad Limitada se reserva el derecho de suspender la entrega en caso de impago o demora, notificando al Usuario e interrumpiendo el acceso hasta que se corrija la situación.
  • Todas las transacciones de pago estarán regidas por la legislación vigente en España y la Unión Europea.
  • En cualquier caso, al hacer clic en “Confirmar”, el Usuario confirma que el método de pago utilizado le pertenece.

6. ENTREGA DE DATOS CLIMÁTICOS

La entrega de datos climáticos adquiridos a través de Sustax se realiza exclusivamente en formato digital. En circunstancias excepcionales y solo con previo aviso y acuerdo mutuo, la entrega puede realizarse en formato físico o mediante medios alternativos, con los costes y condiciones asociados claramente comunicados al Usuario.

El acceso a los datos climáticos adquiridos se garantiza tanto mediante un enlace privado enviado a la dirección de correo electrónico registrada del Usuario como mediante acceso directo en el área personal del Usuario dentro del portal Sustax.

El plazo máximo de entrega del contenido digital será de un (1) día natural desde la confirmación del pedido, salvo casos de fuerza mayor o incidentes técnicos fuera del control de Geoskop Sociedad Limitada.

Los datos adquiridos permanecerán accesibles por un período máximo de noventa (90) días desde la fecha de adquisición.

Todos los riesgos relacionados con el uso, almacenamiento e interpretación de los datos climáticos adquiridos corren exclusivamente a cargo del Usuario desde el momento de la entrega. La propiedad de los datos adquiridos se transfiere al Usuario una vez realizado el pago total, ya sea en Créditos Sustax o medios equivalentes.

En caso de cualquier problema con la entrega, Geoskop Sociedad Limitada se compromete a notificar al Usuario lo antes posible y a cooperar en su resolución.

En ningún caso Geoskop Sociedad Limitada será responsable de retrasos o fallos de entrega resultantes de eventos de fuerza mayor (como desastres naturales, huelgas, interrupciones de red, acciones gubernamentales, etc.).

Es responsabilidad exclusiva del Usuario asegurarse de que todos los datos de contacto proporcionados, especialmente la dirección de correo electrónico, sean correctos y estén actualizados para garantizar la entrega exitosa.

Cualquier reclamación relacionada con la entrega debe dirigirse de manera inmediata al servicio de atención al cliente de Geoskop.

7. PROPIEDAD INTELECTUAL Y USO DE LOS DATOS CLIMÁTICOS

Todos los derechos de propiedad intelectual, derechos de autor y derechos conexos de los contenidos ofrecidos en el Sitio Web, incluyendo sin limitación los datos climáticos, modelos, algoritmos, software, gráficos, bases de datos y documentación, pertenecen a Geoskop Sociedad Limitada o a sus licenciantes.

El Usuario adquiere únicamente un derecho limitado, no exclusivo, intransferible y revocable para usar los datos climáticos adquiridos con fines profesionales, académicos o personales, de acuerdo con estas Condiciones.

Restricciones:

  • El Usuario no puede redistribuir, vender, sublicenciar, compartir públicamente ni explotar los datos climáticos para fines comerciales sin autorización expresa de Geoskop Sociedad Limitada.
  • El Usuario no puede eliminar, alterar ni ocultar avisos de copyright, marcas, nombres comerciales u otros derechos de propiedad en los datos adquiridos.
  • El Usuario se compromete a no usar los datos climáticos para actividades ilegales, fraudulentas o que puedan causar daño a terceros.

Cualquier uso no autorizado de los datos climáticos adquiridos será considerado una violación de derechos de propiedad intelectual, pudiendo dar lugar a acciones legales.


8. CANCELACIÓN Y DEVOLUCIONES

Dado que los datos climáticos se entregan en formato digital y están disponibles para descarga inmediata, no se aceptarán cancelaciones ni devoluciones, salvo que existan errores técnicos o defectos en el contenido entregado imputables directamente a Geoskop Sociedad Limitada.

Política de devoluciones:

  • En caso de error en el envío o en los datos descargables, el Usuario debe notificarlo a Geoskop dentro de un plazo máximo de 5 días hábiles desde la recepción del enlace de descarga.
  • Geoskop Sociedad Limitada se compromete a corregir o reemplazar los datos defectuosos en el menor tiempo posible sin coste adicional para el Usuario.

El Usuario reconoce y acepta que los datos climáticos adquiridos no pueden ser devueltos ni reembolsados debido a la naturaleza digital del producto, salvo lo expresamente indicado en esta sección.


9. RESPONSABILIDAD Y EXONERACIÓN

El Sitio Web y los datos climáticos adquiridos se proporcionan “tal cual” y “según disponibilidad”, sin garantías de ningún tipo, expresas o implícitas, incluyendo garantías de comerciabilidad, idoneidad para un propósito particular o no infracción.

Limitación de responsabilidad:

  • Geoskop Sociedad Limitada no será responsable por daños indirectos, incidentales, especiales o consecuenciales que puedan derivarse del uso o imposibilidad de uso del Sitio Web o de los datos climáticos.
  • La empresa no garantiza la exactitud, integridad o actualidad de los datos climáticos, aunque realiza esfuerzos razonables para mantenerlos actualizados y precisos según estándares científicos y modelos oficiales.
  • Geoskop Sociedad Limitada no será responsable de daños ocasionados por el uso de los datos climáticos para la toma de decisiones comerciales, académicas, profesionales o personales.

El Usuario acepta que toda interpretación, análisis o uso de los datos climáticos adquiridos se realiza bajo su propio riesgo y responsabilidad.


10. PRIVACIDAD Y PROTECCIÓN DE DATOS

El Sitio Web recopila y trata los datos personales del Usuario de conformidad con el Reglamento General de Protección de Datos (RGPD) de la Unión Europea y la Ley Orgánica 3/2018 española sobre Protección de Datos Personales y garantía de derechos digitales.

Datos recopilados:

  • Nombre y apellidos del Usuario
  • Correo electrónico
  • Datos fiscales (cuando corresponda)
  • Información de pago (procesada de forma segura por Stripe)
  • Datos de navegación en el Sitio Web

Finalidad del tratamiento:

  • Gestión de pedidos y adquisiciones de Créditos Sustax y datos climáticos
  • Emisión y almacenamiento de facturas electrónicas
  • Comunicación con el Usuario sobre pedidos, promociones, actualizaciones o incidencias técnicas
  • Cumplimiento de obligaciones legales y fiscales

El Usuario puede ejercer sus derechos de acceso, rectificación, cancelación, oposición, limitación y portabilidad de los datos enviando una solicitud al correo info@geoskop.tech.


11. COOKIES Y TECNOLOGÍAS SIMILARES

El Sitio Web utiliza cookies y tecnologías similares para mejorar la experiencia del Usuario, garantizar el correcto funcionamiento del portal y recopilar información estadística sobre la navegación.

Tipos de cookies utilizadas:

  • Cookies estrictamente necesarias: permiten el funcionamiento básico del Sitio Web y la autenticación del Usuario.
  • Cookies de rendimiento y análisis: permiten analizar cómo los Usuarios interactúan con el Sitio Web, facilitando mejoras en diseño y funcionalidad.

Geoskop Sociedad Limitada adopta medidas técnicas y organizativas razonables para proteger los datos personales del Usuario y los datos climáticos adquiridos frente a accesos no autorizados, pérdidas, alteraciones o divulgación indebida.

Medidas implementadas:

  • Encriptación SSL en todas las transacciones y comunicaciones del Sitio Web
  • Almacenamiento seguro de los datos en servidores con control de acceso
  • Protocolos internos de gestión de incidencias y recuperación ante desastres
  • Actualización regular de software y medidas de seguridad

A pesar de estas medidas, el Usuario reconoce que ningún sistema de transmisión o almacenamiento digital es completamente seguro y que Geoskop no puede garantizar la seguridad absoluta de los datos transmitidos o almacenados.


13. MODIFICACIONES DE LOS TÉRMINOS Y CONDICIONES

Geoskop Sociedad Limitada se reserva el derecho de modificar, actualizar o complementar estas Condiciones en cualquier momento.

  • Las modificaciones serán publicadas en el Sitio Web con indicación de la fecha de actualización.
  • El uso continuado del Sitio Web después de la publicación de los cambios implica la aceptación expresa de las nuevas Condiciones por parte del Usuario.
  • Se recomienda al Usuario revisar periódicamente las Condiciones para mantenerse informado sobre cambios y actualizaciones.

14. LEY APLICABLE Y JURISDICCIÓN

Estas Condiciones se rigen e interpretan de conformidad con las leyes de España.

  • Cualquier disputa, controversia o reclamación que surja directa o indirectamente del uso del Sitio Web, de los datos climáticos adquiridos o de estas Condiciones será sometida a la jurisdicción exclusiva de los tribunales competentes de Madrid, España.
  • Las partes renuncian expresamente a cualquier otro fuero que pudiera corresponderles por razón de su domicilio presente o futuro.

15. RESOLUCIÓN DE CONFLICTOS Y MEDIACIÓN

En caso de conflicto entre el Usuario y Geoskop Sociedad Limitada, las partes acuerdan intentar resolverlo mediante negociación amistosa antes de recurrir a instancias judiciales.

  • Si la disputa no puede resolverse mediante negociación directa, podrá recurrirse a procedimientos de mediación según la legislación española vigente o a otras formas de resolución alternativa de conflictos.
  • El Usuario puede presentar reclamaciones relacionadas con protección de datos ante la Agencia Española de Protección de Datos (AEPD).

16. NULIDAD PARCIAL

Si alguna disposición de estas Condiciones se considera inválida, ilegal o inaplicable, dicha disposición será eliminada o limitada en la medida mínima necesaria, sin que ello afecte la validez, legalidad o aplicabilidad de las demás disposiciones.

  • La invalidez de una cláusula no afectará la continuidad de las obligaciones del Usuario ni de Geoskop Sociedad Limitada bajo las demás disposiciones.

17. DISPOSICIONES FINALES

  • Estas Condiciones constituyen el acuerdo completo entre el Usuario y Geoskop Sociedad Limitada respecto del uso del Sitio Web y de los datos climáticos adquiridos.
  • Cualquier comunicación con Geoskop relacionada con estas Condiciones deberá realizarse a través del correo electrónico: info@geoskop.tech.
  • El Usuario declara haber leído, comprendido y aceptado expresamente todas las disposiciones de estas Condiciones.

This document regulates the conditions (hereinafter, “Conditions”) governing the use of this Website (https://app.sustax.earth) and the purchase and acquisition of data and/or services therein.

For the purposes of these Conditions, it is understood that the activity carried out by Geoskop Sociedad Limitada through the Website Sustax consists of the commercialization and provision of Sustax Credits (“digital credits” or “Sustax Credits”), which allow the User to acquire, access, and download up to 102 years of globally scoped climate data, originally generated and post-processed by Geoskop Sociedad Limitada from climate models from CMIP6 and climate reanalysis models from ERA5, always in accordance with international standards and recommendations of the IPCC (Intergovernmental Panel on Climate Change).

The service provided on the Website corresponds to a digital service, mainly without physical support, in which the User can download the acquired data in CSV file format for professional, academic, or personal use, always under the conditions set forth in this document and applicable regulations.

In addition to reading these Conditions, prior to accessing, browsing, and/or using this website, the User must have read the Legal Notice and the General Terms of Use, including the Cookies Policy and the Privacy and Data Protection Policy of Geoskop Sociedad Limitada. By using this Website or by making and/or requesting the acquisition of data through it, the User consents to be bound by these Conditions and by all the aforementioned, so if the User does not agree with any of them, the User must not use this Website.

It is also informed that these Conditions may be modified. The User is responsible for consulting them each time they access, browse, and/or use the Website, as those in force at the time of the acquisition of products and/or services will apply.

For any questions the User may have regarding the Conditions, the User may contact the owner using the contact details provided above or, where appropriate, by using the contact form.

2. THE USER

Accessing, browsing, and using the Website confers the status of User (hereinafter referred to, interchangeably, as User or Users), whereby, from the time navigation begins on the Website, all Conditions established herein, as well as their subsequent modifications, are accepted, without prejudice to the applicable legal regulations.

The User assumes responsibility for correct use of the Website. This responsibility shall extend to:

  • Using this Website solely for legally valid queries and acquisitions.
  • Not making any false or fraudulent purchases. If a purchase of this nature could reasonably be considered to have been made, it may be canceled and the relevant authorities will be informed.
  • Providing truthful and lawful contact data, such as email address, postal address, and/or other data (see Legal Notice and General Terms of Use).

The User undertakes to use the Website exclusively for lawful purposes and to not perform acts that may harm Geoskop Sociedad Limitada, other users, or third parties. The User is solely responsible for the correct use of acquired climate data and/or the services provided, as well as for the confidentiality of their credentials and all activities carried out under their account.

The User declares being over 18 years of age and having the necessary legal capacity to enter into contracts through this Website, Sustax.

3. THE PURCHASING PROCESS OF SUSTAX CREDITS AND ACQUISITION OF CLIMATE DATA

The duly registered User can purchase Sustax credits (called “Sustax Credits”) in advance by registering and subsequently accessing their personalized account on the Website (https://app.sustax.earth).

The purchase of credits is made through the secure payment platform Stripe (https://stripe.com/es), which guarantees the confidentiality and security of the User’s payment data.

Once acquired, the credits are available in the User’s personal account, ready for accessing and downloading any climate data available on the Sustax platform.

The duly registered User may acquire any of the climate data available on the Website through a digital process. The User must follow the online acquisition procedure on the Website (https://app.sustax.earth), during which various climate datasets can be selected and added to the shopping cart, and then click “Confirm” to proceed.

The User will go through a double validation for the acquisition of climate data. During this process, the User must verify and confirm the information provided at each step before making payment. At any time, the User can modify the data before completing the purchase.

After acquisition, the User will receive a confirmation email from Geoskop Sociedad Limitada, which includes a link to access the acquired climate data.

Credits can be used to access different climate data offered by Sustax, with the balance deducted according to the cost of each selected dataset.

The User can view and download the corresponding electronic invoice, which will be sent by email and available in their personal area on the Website. In addition, the User can access their climate data acquisition history on the Website.

The User does not have the right to receive updates for acquired climate data; new acquisitions are required for updated data. Geoskop Sociedad Limitada will inform all users about the availability of new data and versions as soon as possible.

The User acknowledges, at the time of purchase, that they are aware of certain specific sale conditions relating to the climate data of this Website and displayed alongside its presentation, as well as the limitations and uncertainties of the climate data offered by Sustax.

Finally, any communications, purchase orders, and payments made during transactions on the Website may be archived and kept in the computerized records of Geoskop Sociedad Limitada as proof of those transactions, always respecting reasonable security conditions and applicable laws and regulations, especially Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation – GDPR), and Organic Law 3/2018 of 5 December on the Protection of Personal Data and guarantee of digital rights, and the rights granted to Users in accordance with the privacy policy of this Website.

4. AVAILABILITY

Geoskop Sociedad Limitada undertakes to ensure that all orders placed through the Website are made available to the User in accordance with the established procedures and deadlines, except in cases of exceptional circumstances or force majeure.

Sustax Credits and Climate Data:

Sustax Credits purchased by the User will remain available as long as the Website remains operational.

In the case of climate data acquired with Sustax Credits, their availability and delivery by direct digital access are guaranteed for 90 days following the date of purchase.

Delivery Guarantee:

Delivery of acquired climate datasets is carried out digitally, usually via email and through the User’s personal account. In exceptional circumstances (for example, delivery on physical media), specific conditions will apply and will be communicated during the acquisition process.

Service Level Agreement (SLA):

Geoskop Sociedad Limitada guarantees an average monthly availability of 99% for access to the Website, excluding causes outside the company’s control.

In the event of technical incidents, Geoskop will make reasonable efforts to restore service, with a maximum resolution time of 24 hours for reported incidents, except for causes attributable to external providers or force majeure events.

Force Majeure:

If, for any reason, Sustax Credits and/or climate data cannot be delivered due to Website errors, technical impossibility, or force majeure, Geoskop Sociedad Limitada will notify the User and will offer such credits or data through manual means.

In situations of force majeure (natural disasters, strikes, network interruptions, government orders, etc.), Geoskop will be relieved of responsibility for the duration of the event and will have an additional equivalent period to fulfill its obligations.

Technical Incidents and Maintenance:

The Website may be temporarily unavailable for maintenance, updates, or unforeseen technical incidents. These situations will be duly communicated to Users through the usual channels and will not be considered a contractual breach if they do not exceed reasonable periods or occur repeatedly.

Risk and Liability:

Any risk associated with acquired climate data will be assumed by the User from the moment of delivery.

The User can consult the complete history of their climate data acquisitions and Sustax Credit purchases from their personal account on the Website.

5. PRICES AND PAYMENT

The purchase of Sustax Credits is made in Euros (€) and includes taxes, unless legally required otherwise, particularly concerning VAT. The price displayed on the platform in the local currency selected by the User is for informational purposes only and may be subject to changes due to currency market fluctuations.

The Website provides a display system for the price of Sustax credits in the currency of the User’s choice, for informational purposes only. Users are expressly advised that:

  • The exchange rate applied by the platform may not match the rate applied by the User’s bank due to fees and other factors.
  • The price in local currency may vary depending on currency market fluctuations.
  • Sustax updates its exchange rate API every 24 hours; therefore, the price displayed is for guidance only and is not binding at the time of the actual charge..

The User has a button on the platform to confirm whether, according to European regulations, their Sustax Credit purchases are exempt from VAT. This verification is performed using the data entered by the User in their personal login. Therefore, the User is advised to correctly complete all tax information requested in the personalized login on the Website.

The payment process is structured in two distinct phases:

  • Purchase of Sustax Credits: The User purchases a certain amount of credits in advance, in Euros (€), which are loaded into their personal account within the platform for later use.
  • Purchase of climate data using Sustax Credits: Once the credits are available in the account, the User may use them to access and download the various climate data offered on the Website, with the number of credits corresponding to the type of data requested being deducted from their balance.

The prices for climate data available on the Sustax platform are expressed in “Sustax Credits,” the specific cost of which depends on the type of climate data selected, as detailed on the Sustax website.

Payment methods

  • Payment by credit or debit card, managed through the Stripe electronic payment platform (https://stripe.com/es).
  • Bank transfer: If the User wishes to make payment by bank transfer, they must contact Geoskop Sociedad Limitada directly at info@geoskop.tech to agree on the specific terms of the transaction.

Credit cards are subject to verification and authorization by the issuing bank. If the bank does not authorize payment, Geoskop Sociedad Limitada will not be responsible for any delay or non-delivery and will not be able to enter into any contract with the User.

Once Geoskop Sociedad Limitada receives the User’s purchase order through the Website, a pre-authorization will be made on the corresponding card to ensure there are sufficient funds to complete the transaction. The card will be charged at the time the shipping confirmation and/or confirmation of the service provided is sent to the User as established.

Geoskop Sociedad Limitada uses all means to ensure the confidentiality and security of payment data transmitted by the User during transactions through the Website. As such, the Website uses a secure SSL (Secure Socket Layer) payment system.

Registry and Documentation

  • Purchase of Sustax Credits: Once the purchase is complete, the system will automatically generate an electronic invoice, which will be accessible in your personal space within the platform.
  • Acquisition of climate data: For each climate data acquisition transaction using Sustax Credits, the system will automatically issue an invoice, which will be recorded in your account, along with the relevant documentation for the transaction.

Additional Conditions

Under no circumstances will the Website automatically add additional costs to the price of a product or service, but only those that the User has voluntarily and freely selected and chosen.

Geoskop Sociedad Limitada reserves the right to modify prices at any time, guaranteeing that prices applied to confirmed orders will not be altered.

Geoskop Sociedad Limitada reserves the right to suspend delivery in the event of non-payment or delay, notifying the User and interrupting access until the matter is corrected.

All payment transactions will be governed by current legislation in Spain and the European Union.

In any case, by clicking “Confirm“, the User confirms that the payment method used is their own.

6. CLIMATE DATA DELIVERY

The delivery of climate data acquired through Sustax is made exclusively in digital format. In exceptional circumstances and only with prior notice and mutual agreement, delivery may be provided in physical format or via alternative means, with any associated costs and conditions clearly communicated to the User.

Access to acquired climate data is ensured both via a private link sent to the User’s registered email address and through direct access in the User’s personal area within the Sustax portal.

The maximum delivery timeframe of the digital content will be of one (1) calendar day from the date of order confirmation, except in cases of force majeure or technical incidents beyond Geoskop Sociedad Limitada’s control.

The acquired data will remain accessible for a maximum period of ninety (90) days from the date of acquisition.

All risks related to the use, storage, and interpretation of the acquired climate data are borne exclusively by the User from the moment of delivery. Ownership of the acquired data is transferred to the User once the total payment, either in Sustax Credits or equivalent means, has been completed.

In the event of any issues with delivery, Geoskop Sociedad Limitada undertakes to notify the User as fast as it can and to cooperate in their resolution.

Under no circumstances will Geoskop Sociedad Limitada be liable for delivery delays or failures resulting from force majeure events (such as natural disasters, strikes, network interruptions, government actions, etc.).

It is the User’s sole responsibility to ensure that all contact details provided, especially the email address, are accurate and current to guarantee successful delivery.

Any claims relating to delivery should be promptly directed to Geoskop’s customer service.

7. TECHNICAL MEANS TO CORRECT MISTAKES

The User is hereby informed that, should they detect any mistake in the purchase of Sustax Credits via the Website, they may request its modification by contacting Geoskop Sociedad Limitada through the contact channels provided on the Website, or through the designated customer support channels, and/or by using the contact information set out in Section 1 (General Information).

In accordance with applicable legislation, the User does not have the right to a refund for the acquisition of digital climate data acquired using Sustax Credits.

For further information on how to exercise their right to correction, the User is advised to consult the Legal Notice and General Terms of Use, as well as the Privacy Policy, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) and Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights.

8. RETURNS

It is important to note that under no circumstances will the value of Sustax Credits already used or consumed to purchase climate data from Sustax be refunded, pursuant to the legal exception that excludes the right of withdrawal once the consumer has accessed the purchased digital content, unless there is a defect or error of conformity in accordance with the warranty regulations.

In cases where the User purchases Sustax Credits on or through the Owner’s Website, they have a series of rights, as listed and described below:

Withdrawal Right of Sustax Credits

The User, as a consumer and User, makes a purchase of Sustax credits on the Website and, therefore, has the right to withdraw from said purchase within 14 calendar days without the need for justification.

This withdrawal period will expire 14 calendar days after the day the User or a third party authorized by them acquired digital possession of the Sustax credits purchased on the Website, https://app.sustax.earth, owned by Geoskop Sociedad Limitada.

This Website, Sustax, keeps a record of deliveries and transactions to ensure traceability and facilitate the resolution of any dispute. Once the credits are returned, the user loses the right to their future use.

Credits will not be refundable in cases expressly excluded by applicable regulations (personalized products, expired withdrawal period, etc.).

To exercise this right of withdrawal, the User must comply with the following conditions:

  • Notification: The User must notify Geoskop Sociedad Limitada of their decision. They may do so, where appropriate, through the contact spaces provided on the Website or by email to info@geoskop.tech.
  • Non-use of credits: The User may request a refund of unused Sustax credits at any time during the withdrawal period (14 calendar days from the date of purchase), provided they have not made any purchases or accessed weather data with said credits..

There are three possible scenarios for exercising the right to dissent:

  • Full Refund: If no credits have been used and the request is made within the 14-day withdrawal period, a full refund will be issued using the original payment method, at no additional cost.
  • Partial Refund: If some credits have been consumed, only the unused balance will be refunded, calculated based on the unit price in effect at the time of purchase.
  • No Refund: After the withdrawal period expires, no refund is owed, except in specific cases that may be reviewed at the discretion of Geoskop Sociedad Limitada.

Regardless of the means chosen to communicate their decision, the User must clearly and unequivocally state their intention to withdraw from the purchase contract. In any case, the User may use the model withdrawal form that Geoskop Sociedad Limitada provides in these Terms; however, its use is not mandatory.

Withdrawal Conditions

To comply with the withdrawal period, it is sufficient that the communication unequivocally expressing the decision to withdraw is sent before the expiration of the (14) calendar day period from the purchase of Sustax Credits.

In the event of withdrawal, Geoskop Sociedad Limitada will reimburse the User for all payments received, requested by the User and not spent on Sustax Credits, without undue delay and, in any case, no later than 14 calendar days from the date on which Geoskop Sociedad Limitada is informed of the User’s decision to withdraw.

This reimbursement will not incur any additional costs for the User. However, Geoskop Sociedad Limitada will not, under any circumstances, refund the value of credits already used/consumed to acquire climate data at https://app.sustax.earth, pursuant to the legal exception that excludes the right of withdrawal once the consumer has accessed the purchased digital content, unless there is a defect or error of conformity in accordance with the warranty regulations.

The User acknowledges that there are exceptions to the right of withdrawal, as set forth in Article 103 of Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws. By way of example, but not exhaustive, this would be the case with: personalized products; products that may deteriorate or expire quickly; music or video CDs/DVDs without their packaging, as sealed at the factory; Products that, for hygiene or health reasons, are sealed and have been unsealed after delivery; or the supply of digital content without physical support, the latter being the case with Sustax.

This same law governs the provision of a service that the User may contract on this Website, as this same Law establishes that Users will not have the right to withdraw when the provision of the service has been fully executed, or when it has begun, with the express consent of the consumer and User and with their acknowledgment that they are aware that, once the contract has been fully executed by Geoskop Sociedad Limitada, they will have lost their right to withdraw.

Express consent and loss of Withdrawal Right

The right of withdrawal will automatically be lost once the Sustax credits purchased to view or download climate data are used or consumed. Therefore, you may only exercise the right of withdrawal for Sustax credits that remain unused in your account.

Return of climate data

This applies to all cases in which the User believes that, at the time of delivery, the climate data does not match their expectations, and there may be a disagreement of any kind (inaccuracy or error).

The User may contact Geoskop Sociedad Limitada through the same means or using the contact information provided in the previous section (Right of Withdrawal) to justify the perceived disagreement.

Geoskop Sociedad Limitada will verify the climate data request made by the User in its database and ensure that it complies with the CSV file provided to the User.

Under no circumstances will Geoskop Sociedad Limitada issue refunds for inaccuracies or errors in the climate data acquired.

Geoskop Sociedad Limitada provides climate data and forecasts based on advanced scientific models and proprietary, scientifically reviewed algorithms. However, given the essentially probabilistic and uncertain nature of weather forecasting, Sustax does not guarantee the accuracy, precision, or reliability of any of the data available on this Website.

Therefore, the User waives the right to claim reimbursement from Geoskop Sociedad Limitada for errors or inaccuracies in any of the weather data available and/or acquired on this Website.

9. GUARANTEES

Geoskop Sociedad Limitada guarantees the User the effective and accessible delivery of the climate data acquired through the Website, providing said information in a standard digital format (CSV text file). The User may access the acquired data either through a private link sent to their email or through their personal area on the platform, where it will be available free of charge for the first 90 days after purchase.

Geoskop Sociedad Limitada, as the owner of the Website, has automated systems to verify the timely delivery of the climate data access link. If the User does not receive the dataset within the reasonable timeframe indicated in the purchase confirmation, they should contact customer service (info@geoskop.tech) to identify and resolve any technical or delivery issues.

Geoskop Sociedad Limitada maintains a real-time record of Sustax Xredits purchase requests, as well as their purchase status.

Geoskop Sociedad Limitada guarantees the protection of the User’s personal data in accordance with current regulations on personal data protection, especially the General Data Protection Regulation (GDPR) and Organic Law 3/2018 on Personal Data Protection and the Guarantee of Digital Rights.

The guarantees and limits of liability provided herein are governed by applicable Spanish and European legislation on consumer protection and digital contracting. The User retains all rights and guarantees granted by current regulations as a consumer. The terms and conditions of this guarantee are specified below, adapted to the reality of the purchase and delivery of digital data by email, and aligned with applicable Spanish regulations.

  • Availability of purchased Sustax credits: These digital credits allow the User to acquire climate data and are available indefinitely through private access to the User’s Sustax account.
  • Purchase and confirmation: Once the purchase of a climate dataset is formalized, the User will receive an order confirmation by email, which includes the order reference and a private access link to the data.
  • Verification and resolution of incidents: Sustax has automated systems to verify the timely delivery of emails with the purchased data. If the User does not receive the dataset within the reasonable timeframe indicated in the purchase confirmation, they should contact the support team (info@geoskop.tech) to identify and resolve any technical or delivery issues.
  • Guarantee of receipt: If email delivery is unsuccessful due to an error attributable to Sustax (for example, a technical failure on the platform, an error in automated delivery, etc.), Sustax undertakes to resolve the incident within a maximum of 24 hours of the User’s notification, guaranteeing the resending of the purchased content or, in exceptional cases, a refund of the amount.
  • Alternative access: Access to the acquired climate data is also available through the User’s personal access to this website.
  • History and traceability: All Sustax Credit purchases and all climate data sent are recorded in the Sustax system and viewable by the User. This allows the User to verify the date and time of sending, as well as the recipient of the email.

Additional conditions and limitations

  • Verification of the User’s email address: It is the User’s responsibility to ensure that the email address provided is correct and operational. Sustax will not be liable for non-receipt if the error is due to an incorrect address, blockages on the User’s email server, spam filters, or any other incident beyond the platform’s control.
  • Verification of the User’s tax information: It is the User’s responsibility to ensure that the tax information provided is correct for proper invoicing and implementation of the VAT regime.
  • Physical delivery: In the event that, exceptionally, physical delivery is required (for example, on external media), the User will be expressly informed during the purchase process, and the specific physical delivery conditions indicated in the general conditions will apply.
  • Force majeure: Geoskop Sociedad Limitada will not be liable for delays or incidents in delivery due to force majeure, including, but not limited to, internet service failures, third-party server outages, or incidents with publicly available email services.

Unless otherwise provided by law, Geoskop Sociedad Limitada shall not be liable for any loss, damage, or injury not directly attributable to breach of contract or negligence on its part. This limitation includes, but is not limited to:

  • • Indirect, consequential, collateral, special, or punitive damages that were not reasonably foreseeable by both parties at the time of entering into the contract.

The User agrees that this clause is interpreted within the broadest scope permitted by applicable law.

Furthermore, the User expressly acknowledges and agrees that:

  • The climate data offered are projections and estimates based on scientific models and algorithms, subject to uncertainty, variability, and limitations inherent in climate science.
  • Under no circumstances does Geoskop Sociedad Limitada guarantee the accuracy, precision, timeliness, completeness, suitability, availability, consistency, timeliness, or suitability of the climate data for any specific use or purpose.
  • All data on this Website is provided “as is,” without warranties of any kind, and any decision or action based on it is made under the sole responsibility of the User.
